This case concerns a company by the name of Actors Equity, an employee and Bank of New York. In 18 Actors Equity were in search of a new comptroller. After reviewing applications, they chose Nicholas Scotti as their new comptroller. In his application, he stated that he had held various financial positions with reputable companies. Actors Equity chose to offer Mr. Scotti the position without contacting previous employees and conducting a background check.


Actors Equity maintained a checking account at the Bank of New York. Within the first six months Scotti forged the signature of the appropriate employees on four checks totaling $100K. All checks were made payable to N. Piscotti. The bank paid the checks. Once Scotti resigned Actors Equity conducted some research and they found that Scotti's real name was actually N. Piscotti. Actors Equity sued the drawee bank to recover the $100K.


In this case Scotti did not act ethically. First, he lied about his real name. Second, he inflated his resume to seem as if he had an extensive job history with reputable companies. Third, he lied about having a criminal history in order to be considered for the new position. Fourth, he forged the signatures of company employees to enable him to cash the checks under his real name. Fifth, he cashed the checks knowing that the money was not rightfully his.


There are many items to consider when deciding if Actors Equity should have sued Bank of New York to recover the forged checks. The bank does have a duty of care when conducting business for a customer. As far as the bank was concerned each of the cashed checks were valid. Each of them contained proper authorizing signatures from Actors Equity. When the checks were presented, the presenter had proper identification to satisfy the validity of the check. The forged signatures were of professional quality. As far as the bank is concerned they did nothing out of the ordinary and certainly did not conduct themselves negligently.


Actors Equity had a great deal of negligence on their part. If this company had conducted a contact to Scotti's previous employees, they would have discovered that he was not employed with them and certainly not as a comptroller. With a simple check on this person they would have discovered the most important thing, that this person's name was not Nicholas Scotti, but it actually was Nicholas Piscotti. Another area that they failed to consider is their internal controls in regards to checks. If Actors Equity would have had a better system to ensure checks validity before they are released, the check might have been caught before they were drawn.


When considering forgery and negotiation of invalid checks the onus falls on the party that had the greater opportunity to prevent the fraud. In this case it was Actors Equity. They failed on several occasions to prevent this and failed to do so. As far as the law is concerned, they have no recourse to go back to Bank of New York and recover the amount of the forged checks.


In this case The Bank of New York wins. They conducted themselves correctly in the cashing of the checks. The Quakers actively protested against it, the Presbyterian Church made several formal declarations against it, and the Methodist Church opposed it as an evil institution. Abraham Lincoln also opposed slavery. He was perhaps the most influential in abolishing slavery, he started the civil war between the Union (north) and the Confederates (south) in order to give black slaves their freedom. In 1865, the US Congress approved the Thirteenth Amendment to the United States Constitution, to abolish slavery. After the conclusion of the Civil War, slavery was abolished throughout the entire US. Through the actions and leadership of people like Martin Luther King, Jr., many improvements have been made in the area of human rights in the US. Racial equality is still constantly improving.

I have decided upon several goals, three of which I believe is more obtainable and most advantageous and beneficial to me at this time in my life. I want to obtain a degree. I want to increase my knowledge of a subject that is conducive to my pursuit of life's comfort and happiness. And, I want to make practical the standard I teach my daughter, which is, education first.

William of Orange would be considered a politique because he assisted greatly in the Compromise of 1564 in the Netherlands. Also by helping and persuading the northern Protestant regions of the Netherlands to join with the southern Catholic regions of the Netherlands to help eliminate Spanish rule.


Political survival was the top priority of all politiques of the time. Religion had been a problem for far to long. By having a ruler that was not so involved with having their country all one religion, the politiques believed that the political view of their country would be changed. All three rulers saw, during their reign, that such change did indeed occur. Henry of Navarre's edict made sure of the beginnings of religious freedom in France, and Elizabeth I continued that tradition in England. This separation of these countries' religions from that of the ruler was a great step in the establishment of what would become the American tradition of separation between church and state. William of Orange was a Protestant in a very Catholic country. His flight to the Netherlands brought about the Compromise in the Netherlands that helped them eliminate Spanish rule of the Netherlands.


With their leaders not overly concerned about religion, the common people, artists and musicians were allowed to express themselves in many more ways than previously. The Baroque period in architecture and music was a combination of extremely ornate and very simple styles. The Catholic church and the rulers who subscribed to that religion built ornate and elaborate churches, while the politique rulers allowed poets, musicians and other craftsmen freedom to express themselves in ways that would not have been allowed under a strict religious reign.


In conclusion, the politique attitude of self-preservation helped pave the way in 16th Century Europe for the coming of the next wave of reform. The willingness of the rulers to place their political careers before their religious beliefs allowed the culture and economics of their respective countries to survive and even thrive. The Baroque style of architecture, art and music, brought about by the Catholic Church to protest the plainness of Protestant worship and belief, provided work for the common laborer as well as the many artists and musicians of Europe. The legacy of rich art, music and architecture is still ours to enjoy.
